Prayer: Writ Petition filed under Article 226 of the Constitution of India seeking a Writ of Mandamus directing the respondents herein to consider the representation dated 12.08.2022 to grant the necessary permission required in conducting the said Ganesh Chaturthi festival in the said Ukkadam Area in Coimbatore.

O R D E R

This writ petition has been filed seeking a direction to the respondent police to grant permission to the petitioner to install Vinayaka Idol at Pullakadu Housing Unit, Ukkadam South, Coimbatore and celebrate Vinayaka Chaturthi festival on 31.08.2022.

  1. According to the petitioner, the residents in the housing colony wants to celebrate Vinayaka Chaturthi in their area and that other community people are also willing to participate in the said celebrations and they have also agreed to even offer annadhanam to the devotees, therefore she seek permission.
  2. The learned Additional Public Prosecutor, appearing for the respondent police filed counter and also submitted that the area is predominantly surrounded by Muslim community and therefore there will be a law and order problem.
  3. However, the learned counsel appearing for the petitioner submitted that even the Jamath people there are willing to participate in the celebrations and they have no objections.
  4. Such view of the matter, the petitioner is permitted to file affidavit/undertaking before the concerned police station along with the affidavit of Jamath Committee to instal Vinayakar idol and conduct Vinayaka Chaturthi festival on 31.08.2022 at their housing unit, by strictly following the guidelines prescribed under the Government Order in G.O.Ms.No.598, Public (Law & Order.B) Department, dated 09.08.2018. On such undertaking being given by the petitioner to the respondent police, the respondent police shall ensure proper protection.  However, it is made clear that the petitioner shall only instal Vinayakar idol inside their housing unit and celebrate the function and there should not be any procession along with the idol. The writ petition is disposed of accordingly.  No costs.
