Judge question acter advocate whether the Petitioner is inclined to pay the interest component or not

Petition under 482 of cr p c have been filed on behalf of Actress Jayapradha and her brother Rajababu before the Hon’ble High Court, Madras seeking to set aside the order passed by the sessions court dismissing her petition to suspend the sentence. The said petition was listed for hearing today.Senior Counsel Abdul Hameed, appeared on behalf of Actress and former MP Jayapradha and argued that the contribution amount has been paid during the pendency of the prosecution. However without considering the same the Learned Metropolitan Court had imposed sentence besides directing to pay the contribution amount. Therefore the Learned Senior Counsel insisted for suspension of sentence. However during the course of hearing, the Counsel appearing on behalf of ESI has produced a statement claiming interest and damages amounting to 37 lakhs for which the senior counsel argued that No proceedings has been passed in respect of the said claim and the same is not tenable. However the Hon’ble court has directed the petitioner to inform the court on 11.10.23 as to whether the Petitioner is inclined to pay the interest component or not as claimed by ESI and posted the case on 11.10.23.
