Dr.G.JAYACHANDRAN, J.

For making defamatory and derogatory statements against the Chief Minister and Minister for Youth Welfare and Sports Development, a case has been registered against the petitioner in Crime No.731 of 2023 on 19.09.2023, for the objectionable utterance made in a public meeting. The petitioner, who is former M.L.A., apprending arrest in view of the registration of compliant.

  1. The learned counsel appearing for the petitioner submits that after realising that unparlimentary expression been used while referring the Chief Minister and his Son, who is also Minister in Cabinet, the petitioner has conveyed his regret through Twitter and Whatapp, therefore seeks protection from arrest.
  2. This Court, on perusing the F.I.R. and the objectionable utterance alleged to have been made by the petitioner in the public meeting, does not find any reason to grant protection from arrest. Having made objectionable utterance in the public meeting, secret communication in Twitter and Whatapp is not proportionate act of regret. If the petitioner is ready to convene public meeting in the very same place and tender apology, it will make some sense.
  3. The learned counsel for the petitioner seeks time to get instructions. On his request matter is adjourned on 11.10.2023.
