சனாதனம் என்பது பல்வேறு கடமைகளை உள்ளடக்கிய தொகுப்பு என்றும், அது சாதியவாதத்தையும், தீண்டாமையையும் ஊக்குவிப்பதாக கருத்து நிலவுகிறது என்றும் குறிப்பிட்டுள்ள சென்னை உயர் நீதிமன்ற நீதிபதி என்.சேஷசாயி, தீண்டாமை கொடுமையை ஒழிக்கும் வகையில் மாணவ – மாணவியரை கல்லூரி ஊக்குவிக்க வேண்டுமென அறிவுறுத்தி உள்ளார்.

பேரறிஞர் அண்ணா பிறந்தநாளை முன்னிட்டு, திருவாரூர் அரசு கலைக் கல்லூரியில் சனாதன தர்மத்துக்கு எதிரான கருத்துக்களை பகிரும்படி சுற்றறிக்கை வெளியிடப்பட்டதை எதிர்த்து இந்து முன்னணி அமைப்பின் செய்தித் தொடர்பாளர் இளங்கோவன் என்பவர் சென்னை உயர் நீதிமன்றத்தில் வழக்கு தொடர்ந்திருந்தார்.

இந்த வழக்கு நீதிபதி என்.சேஷசாயி முன் விசாரணைக்கு வந்த போது, கல்லூரி வெளியிட்ட சுற்றறிக்கை திரும்பப் பெறப்பட்டுள்ளதாக அரசுத் தரப்பில் தெரிவிக்கப்பட்டது.

இதை பதிவு செய்து கொண்டு வழக்கை முடித்து வைத்த நீதிபதி சேஷசாயி, சனாதன தர்மம் என்பது ஹிந்துக்களின் நித்திய கடமைகள், தேசத்துக்கான கடமை, பெற்றோருக்கு செய்ய வேண்டிய கடமை உள்ளிட்ட கடமைகளின் தொகுப்பு என விளக்கமளித்துள்ளார்.

இந்த கடமைகள் அழிக்கத்தக்கவையா எனவும், குடிமகன் நாட்டை நேசிக்க கூடாதா? நாட்டுக்கு சேவையாற்றுவது கடமை இல்லையா? பெற்றோரை பராமரிக்க வேண்டிய கடமை இல்லையா? எனவும் நீதிபதி கேள்வி எழுப்பினார்.

சனாதனம் சாதியவாதத்தையும், தீண்டாமையையும் ஊக்குவிப்பதாக ஒரு கருத்து நிலவுகிறது எனக் குறிப்பிட்ட நீதிபதி, நாட்டில் தீண்டாமையை சகித்துக் கொள்ள முடியாது எனவும், அனைத்து குடிமக்களும் சமமானவர்கள் எனவும் குறிப்பிட்டார்.

மத பழக்க வழக்கங்களில் சில மோசமான நடைமுறைகள் தெரியாமல் புழக்கத்தில் இருக்கலாம் எனக் கூறிய நீதிபதி, அவற்றை களையெடுக்க வேண்டுமே தவிர, அதற்காக பயிரை ஏன் வேரறுக்க வேண்டும் எனக் கேள்வி எழுப்பினார்.

தீண்டாமைக் கொடுமையை ஒழிக்கும் வகையில் மாணவ – மாணவியரை கல்லூரி ஊக்குவிக்கலாம் என்றார்.

ஒவ்வொரு மதமும், நம்பிக்கைகளின் அடிப்படையில் தோற்றுவிக்கப்பட்டவை எனக் குறிப்பிட்ட நீதிபதி, கருத்து சுதந்திரம் என்ற பெயரில் மற்றொருவரை காயப்படுத்தாமல் இருப்பதை உறுதி செய்து கொள்ள வேண்டும் என அறிவுறுத்தியுள்ளார்.

A judge of the Madras High court wondered whether Sanatana Dharma should to be destroyed on

Sanatana Dharma is a set of eternal duties enjoined upon those who follow the Hindu way of life. It includes the duty to the nation, duty to the king, the king’s duty towards his people, duty to one’s parents and gurus, care for the poor, among other things. “Are all these duties liable to be destroyed?” a judge of the Madras High court wondered on Friday after taking note of the ongoing debate across the country on the subject.

Justice N. Seshasayee wrote that he was conscious of the “very vociferous, and at times noisy debates on pro and anti Sanatana Dharma”, and therefore, could not help but ponder over it in a judicial order due to genuine concern for what was going around. He said the duties listed under the Sanatana Dharma could not be traced to any one specific literature since they had been gathered from multiple”
