National Commission for Schedule Caste undertakes not to issue any notice to Murasoli Trust.


Today, the Writ Appeal filed by DMK Murasoli Trust challenging the order of a single judge was heard by the Honourable Chief Justice and Honourable Mr Justice Sathya Narayana Prasad. Mr P. Wilson, appearing for Murasoli Trust, argued that the order of the learned single judge was conferring powers on the National Commission for Schedule Castes (NCSC) to adjudicate on disputes relating to title. He submitted that the Constitution of India had not conferred such power under Article 338 on the NCSC, and such power was only vested in civil courts to adjudicate disputes relating to title. Mr Wilson also produced orders of the Chief Justice bench which granted a stay on similar issues when the jurisdiction of the NCSC was questioned through Writ Appeals.

As the Chief Justice was about to grant interim orders of staying the judgment of the Learned Single Judge, the Learned ASG submitted that he had instructed the Commission not to proceed with the directions of the Learned Single Judge and pleaded not to pass any interim orders. However, the Hon’ble Chief Justice bench, recording the undertaking of ASG Mr Arl Sundaresan, posted the matter for hearing on 25.4.2024.
