NATIONAL LOK ADALAT CONDUCTED BY HIGH COURT LEGAL SERVICES COMMITTEE ON 12.112022

As directed by the Hon’ble Executive Chairman, National Legal Services Authority, New Delhi and also as per the direction of The Hon’ble Patron in-Chief/ The Acting Chief Justice, Hon’ble Mr.Justice T.Raja and as per the direction of The Hon’ble Mr.Justice.S.Vaidyanathan, Chairman, High Court Legal Services Committee and the Hon’ble Committee Judges of the HCLSC, Hon’ble Mr.Justice RMT.Teekaa Raman, Hon’ble Mr.Justice S.M.Subramaniam, Hon’ble Mr.Justice N.Sathish Kumar and Hon’ble Mr.Justice C.Saravanan, the High Court Legal Services Committee at Principal Seat and Madurai Bench of Madras High Court organised National Lok Adalat today in respect of the court pending matters which fall under the category of cases as prescribed by NALSA in the Court Halls of Madras High Court and also in the premises of Madurai Bench of Madras High Court.
Seven Lok Adalat Benches presided over by Hon’ble Mr.Justice M.Dhandapani, Hon’ble Mrs.Justice R.Hemalatha, Hon’ble Mr.Justice G.K.Ilantharaiyan, Hon’ble Mr.Justice C.Saravanan, Hon’ble Mr.Justice Sunder Mohan, Hon’ble Mr.Justice K.Kumaresh Babu, and Hon’ble Mr.Justice B.Gokuldoss Judge, (Retd.) were constituted in the Principal Seat at Madras and Three Benches presided over by Hon’ble Mr.Justice B.Pugalendhi, Hon’ble Mrs.Justice S.Srimathy, Hon’ble Mr.Justice R.Vijayakumar were constituted in the Madurai Bench to dispose of the cases pertaining to Motor Accident Appeals, writ petitions, civil cases, Land Acquisition cases, NI Act cases. Apart from the above, one more Bench presided over by Hon’ble Mr.Justice M.Jeyapaul, Judge (Retd.) was constituted to dispose of the cases pending on the file of State Consumer Disputes Redressal Commission etc.
Under the guidance of Hon’ble Mr.Justice S.Vaidyanathan, Chairman, High Court Legal Services Committee, the National Lok Adalat was organised by the High Court Legal Services Committee in which large number of Advocates and the Officials from various Departments of the State Government and Insurance officials actively participated in the National Lok Adalat.
Hon’ble Mr.Justice S.Vaidyanathan, Chairman, High Court Legal Services Committee , and Hon’ble Mr.Justice S.M.Subramaniam visited the Lok Adalat Benches and had interaction with the parties. While interacting with the parties Hon’ble Mr.Justice S.Vaidyanathan, Chairman briefly narrated the importance of National Lok Adalat to the effect that the intent of National Lok Adalat is to provide an opportunity to litigants, who fight for justice for longer period and to give quietus to the long battle on consensus, as it is a win-win situation. In some cases, matters have been pending for more than two decades in the High Court, which would mean that the original order in question must be not less than 25 years old. The activity / practice of mediation can be traced even in very ancient times.
The denial for peaceful talk ended in great loss of human life in two great epics of Asia, called Ramayana and Mahabaratha. In Ramayana, when Angathan, son of Vali was sent for holding settlement talks with Ravana, it was not accepted by Ravana, as a result of which, in the battle, several warriors, including Ravana was killed by Rama.
Similarly, in Mahabaratha, Duryodhana, in impolite manner, declined the request made by Krishna to give at least five villages to Pandavas to settle the dispute between cousins. This resulted in Kurukshetra / Dharmakshetra war, which lasted for 18 days, in which Duryodhana, his brothers and others lost their lives and the loss was on both sides, viz., Pandavas and Kauravas.
Thus, settlement by way of mediation in all matters, more so in property dispute amongst siblings, Motor Accident Claims and Matrimonial disputes, is the effective tool to bring peace between the parties.
The Advocates, Litigant Public were advised to strictly adhere to the COVID 19 safety protocol. Thiru.A.Nazir Ahamed, Member Secretary, Tamil Nadu State Legal Services Authority was present. The arrangements for the conduct of the National Lok Adalat were made by Tmt.K.Sudha, Secretary/District Judge, HCLSC.
Today in the National Lok Adalat 771 cases on the file of the Principal Bench and 363 Cases on the file of the Madurai Bench of Madras High Court were taken up for settlement. After negotiations between the parties, awards were passed and details of disposal are as follows:-

Totally, 14 cases of five years old before the Principal seat and 10 five years old cases before the Madurai Bench in all 24 cases were disposed of in the National Lok Adalat.
