Today, when the matter is taken up for hearing, learned counsel representing the petitioner in W.M.P.No.2366 of 2023, who has now been  impleaded as one of the party respondent, has produced samples of bio-compostable bags approved by the Institute of Petrochemicals Technology and also by the Tamil Nadu Pollution Control Board.

 

  1. Learned Additional Advocate General has been asked to get instructions from the Tamil Nadu Pollution Control Board as to the nature of the plastics, which are treated as bio-compostable for which approvals are granted by the Board as noticed in the above samples.

 

  1. Learned counsel for the impleaded respondent has stated that the State does not have any composting unit and when a question was put to the learned Additional Advocate General in this regard, the answer was in the negative. Therefore, the Bench has asked the learned Additional Advocate General, i) to explore the possibility of establishing a composting unit, considering the fact that Tamil Nadu Pollution Control Board is already granting approval for bio-compostable bags and ii) to consider, if the writ petitioners, whose units have been closed, can be revived, if those petitioners are able to manufacture such bio-compostable bags after getting due approval from the authorities concerned.
  2.
