    PETITION FOR INTERVENOR
    The address for service of all notice and process on the petitioner is that of his counsels M/S. G.HARI HARA ARUN SOMA SANKAR 2927/2012 Advocates, having office at No 69/7, II A, 2nd Floor, Leelavathi Building, Armenian Street, Parrys, Chennai 600001.
    The address for service of all notices and processes on the respondent is the same as stated above.
  13. The defacto complainant who is the victim in Crime No.7/2024 on the file of the 1st Respondent herein, filing this intervene application and requesting this Hon’ble Court to dismiss the advance plea of bail sought by the Petitioners/Accused 1 to 15 in the above said criminal original petition.
  14. The petitioner states that the averments mentioned in the petition filed by the respondents/accused(s) 1to 15 is denied as false which were stated for aiming to get advance bail from this Hon’ble Court. The 1st to 15th Accused(s)
    is not deserving to get pre arrest bail since A1 and other accused(s) are habitual offenders and they have got similar nature of cases.
  15. The defacto complainant respectfully state that A1 has got previous cases against him before the 1st respondent police and he has got Anticipatory bail in those cases, but did not comply any of the condition imposed thereon. A1 does not have any respect to the order of this Hon’ble Court. The relief for anticipatory bail sought by A1 is liable to be dismissed on account of his bad antecedent and non-compliance of previous orders of this Hon’ble court in Crl.OP No 12867/2024, 12697/2024 and 14475/
    2024.
  16. The defacto complainant/Petitioner is a public spirited senior citizen and retired Teacher, hence he was targeted by A1 and the other accused(s) making him to invest Rs 50,00,000/- and purchase Shares in Green Park School, Kadathur and for his son and further also deceived the Petitioner herein and took Rs 35,00,000/- as loan for the development of Everest Blue Metals a Crusher Unit.
  17. The defacto complainant/Petitioner states that when he claimed for the right of share for his investment and repayment of the loan amount, it was denied and he was intimidated by the Accused(s) 1 to 15.
  18. The defacto complainant /Petitioner further states that there are cases against the 1st accused from the year 2013 in the same modus operandi and till date he is dilly dallying the creditors by giving cheques which gets dishonoured at its presentation in the bank, executes deed of settlement and pronotes and fails to comply it and further gives false complaint against
    the creditors before the police. The 1st Accused invites investors by way of paper advertisement and through known contacts and the accused 2 to 15
    helps the 1st accused in all aspects to get the investment amount from the innocent investors and finally deceive them.
  19. The defacto complainant/petitioner further states that the accused suppressed material facts and attempting to get favourable order from this Hon’ble Court. Similar nature of cases registered against the accused 1to 15. Many of the investors have lodged a complaint’s against A1, but he uses his influence and escapes from the clutches of law, the advance bail plea may not be considered to secure the ends of justice.
  20. The defacto complainant/petitioner request this Hon’ble court to treat the averments stated in the FIR as part and parcel of this petition. The petitioner may be permitted to raise additional grounds at the time of hearing to substantiate his claim.
    For the above stated reasons it is therefore prayed that this Hon’ble Court may be pleased to permit to intervene in Crl.O.P.No: 19828 of 2024 and dismissed the above anticipatory bail petition and pass such orders or further other orders in the circumstances necessary and thus render justice.
