It’s a beginning period not much known and yet to catch up with Bench Bar and Public The Registry of Madras High Court had never seen such a Writ because I mentioned in my affidavit that it’s a Public Interest Litigation and therefore it refused to number for the 1st reason that I have no locus standi to question the appointment of the Professors of Law College, Madras made by the Government of Madras and even if I claim its maintainable it is barred by latches since it is questioned a very belated stage. I cited India’s First PIL Mumbai Kamgar Sabha v. M/s Abdulbhai Faizullabhai and others the case seed of PIL sown by Late Justice Krishna Iyer of Supreme Court and it was circulated to the Writ Judge Late Justice S. Padmanabhan and it was numbered. I knew very well the impact of the PIL on me yet I was ready to sacrifice my ML degree for the betterment of all. The Writ was argued Party in Person against my “Professor” S. Krishnasawmy who was not qualified for the very appointment of Juniour Professor in the Law College Madras and there were many like him “Professor” Paul, “Professor” Parpooranam etc. The Writ came for admission before Late Justice S. Padmanabhan in those days Hall No.18 where all subjects of Writs was handled by him only. I argued before the Judge that Professor Krishnasawmy Respondent-1 does not possess any the required qualifications and Bar standing to be appointed as Juniour Professor and he is a direct appointee from one of the department of Secretariat and thereafter promoted as Professor. appointed in the Madras University Board of Examination in Legal Studies and he cannot take classes for students in the subject of Administrative Law and Industrial Law a new subject that was introduced the time I joined ML since he possessed different subject and there are every possibility of him becoming the Director of Legal Studies without qualification. The exact qualification background of Respondent-1 was not known to any one and therefore none questioned his appointment and I came to know about it after joining ML in Law College, Madras now I have challenged his appointment by way of Writ of Quo Warranto in the interest of academic, present and future student community and public and doesn’t attract laches. The Judge heard me in length with many more things involved in the Writ without any interruption and after completion the Judge told to me that he would pose three questions to me and if I give convincing answers to him the Writ would be admitted. All the three questions were answered before he could finish them. The Judge asked me how I am able to fore his questions before he could complete it I answered it should be the chain of question without a missing link. The Judge asked my standing in Bar and how many cases I have conducted in High Court? I said this was my 1st case. He starred at me for few seconds and that worried me could it be for dismissal? The Judge closed the bundle hit the Bench to say Admit Notice but refused to grant stay. The next day in English and Tamil news paper this was published. I remember seeing our Press Sekar along with other Press Reporters taking notes of my argument. In open Court the Judge asked me am I interested in academic side? I said my interest is into profession. Late Justice S. Padmanabhan told me in that case its better for me to concentrate in profession as my performance and presentation well with my forceful argument. I must make a mention about Advocate R. Gandhi (as he then was) he was sitting in Bar and watching me arguing. I came out of the Court Hall after admission he came out called me by my name and shook hands with me and congratulated and appreciated me over my arguments and the prompt answers of the Judge and told me that No High Court Judge has ever appreciated any person in open Court and you are the first person get it and keep it up and he also advised me to concentrate in profession. Senior Advocate R. Gandhi was the only person to give the compliments to me. I cannot forget that Court day. Within a week of WP admission “Professor” Krishnasawmy resigned and I was not serious of ML when I knew it will not help me in any extra way except to put ML next to my name and by looking at the ML clients are not going to come to me and it’s all a different world where I have swim and became full fledged Advocate.
