*M. Fredrick Monika Vs. The Inspector General of Registration & 2 Ors.*
W.P. No. 32582 of 2022
Dated: 05.12.2022

*HON’BLE MR. JUSTICE R. SUBRAMANIAN* dismissed the Writ Petition in the matter relating to *“Marriage – Solemnized – Valid”*, and further observed and held as follows:

1) The Case of the Petitioner was that her marriage was solemnized without her consent and therefore, it should not be registered.

2) Held that such a Mandamus cannot be issued, once marriage is solemnized, even without registration, it is by itself valid. It can only be dissolved by a decree of the Court.

3) Hence, the writ petition was dismissed, leaving it open to the Petitioner to approach the Civil Court or other appropriate forum to seek declaration that marriage is invalid.
