Prayer: Civil Miscellaneous Appeal is filed under under Section 82(2) of ESI
Act, praying to set aside the order dated 25.10.2018 passed in
E.I.O.P.No.117/2007 on the file of the Employees Insurance Court (Principal

The respondent shall move the ESI Court within a period of four (4)
weeks from the date of receipt of a copy of the order. The respondent shall
deposit 30% of the amount claimed with the ESI Court along with the
application under Sections 75 and 76. The ESI Court shall thereafter determine
the quantum of contribution, if any, payable and also determine the question
whether the demands were raised within a reasonable time or not, after
[31/01, 07:50] sekarreporter1: considering the prejudice, if any, caused to the respondent for the delayed
action taken by the Corporation. The ESI Court shall determine the issue
without reference to the observations, if any, made in this Judgment.
Consequentially connected Miscellaneous Petitions are closed. There shall be
no order as to costs.
