The Madras High Court Advocates Association would like to point out that the Bar Council of Tamil Nadu & Puducherry, a Statutory Body under the Advocates Act, 1961, issues Vehicles Stickers to enrolled advocates after verification of their RC Books & Enrolment Certificates, with the Vehicle Registration Number and Hologram. This is meant for seamless entry and parking on Court campuses and not to seek immunity from traffic rules. A clear distinction needs to be made between the issue of such authorised stickers by a statutory body and advocate stickers sold on pavements which even non-advocates may end up misusing.

The Chennai City Traffic Police has issued a Press Note No.89/04/2024 dated 27.04.2024 on “Restriction of Unauthorised Stickers on Private Vehicles”. There is a reference, inter alia, to Advocate Stickers, with a warning to book cases from 02.05.2024 under Section 198 of the Motor Vehicles Act and Rule 50 of the Central Motor Vehicle Rules.

Even Apartment Associations issue stickers to regulate entry of vehicles of outsiders into gated communities.

The provisions of law cited in the impugned Press Note are also irrelevant and contextually inapplicable. Section 198 of the Motor Vehicles Act pertains to unauthorised moving of a stationary vehicle or tampering with brakes or any part of the mechanism. The pasting of an official sticker clearly does not attract this section. Rule 50 of the Central Motor Vehicle Rules admittedly relates to defective number plates and cannot apply to stickers on windshields of vehicles.

Under the above circumstances, facts and correct interpretation of the statute, the Madras High Court Advocates Association urges the Chennai Traffic Police to withdraw the reference to advocates stickers on vehicles of duly enrolled advocates.
