THE HON’BLE MR.T.RAJA, ACTING CHIEF JUSTICE AND THE HON’BLE MR.JUSTICE D.BHARATHA CHAKRAVARTHY W.P.No.5814 of 2023 M.I.Mohamed.We find merit in the aforesaid submission made by learned Additional Government Pleader (Pondy) appearing on behalf of respondents 1 and 2. It is trite that in respect of any dispute pertaining to wakf or wakf property, the aggrieved person has to first approach the Wakf Tribunal and he cannot straight-away come to this Court by filing a writ petition under Article 226 of the Constitution of India. In view of the availability of an alternative statutory remedy, which is equally efficacious, the writ petition is dismissed with liberty to the petitioner to approach the Wakf Tribunal. There will be no order as to costs. (T.R., ACJ.) (D.B.C., J.)
