[25/03, 11:23] sekarreporter1: [25/03, 11:22] sekarreporter1: The DMK candidate Mr. T. Senguttuvan had challenged the election of a AIADMK candidate K. Ashok Kumar in the 2021 Assembly elections to the Krishnagiri Assembly constituency before the Madras High Court.

In the said election petition the DMK candidate had filed an application to appoint a Registrar of the HC to verify and recount the 605 postal ballots that were rejected by Returning Officer during counting.

Mr. Richardson Wilson, Advocate appeared for the DMK candidate and argued that these 605 ballots were not dealt with in accordance with law. They were rejected for flimsy reasons, which were not communicated to the candidates. Thus he prayed that the postal ballots must be recounted by a Registrar of the Court. He further contended that the margin was only 794 votes and thus has a material effect on the election.

In this application Hon’ble Ms. Justice P.T. Asha passed orders today, accepting the contention of the election petitioner and directed the 605 postal ballots to be recounted by the Registrar of the High Court in the presence of two officials to be deputed by the Election Commission of India and in the presence of both the candidates Mr.T.Senguttuvan and Mr.K.Ashok Kumar or persons authorised by them and submit a report to the Court.

The said exercise is to be completed in one month’s time
