PRAYER : Petition filed under section 11 & 12 r/w. Section 2(b) of the Contempt of Courts Act, to punish the respondent herein for willful disobedience of the common order dated 02.09.2022, passed by this Court in WP.No.23367 of 2018 and WMP.Nos.1009, 6098 & 6099 of 2022.

O R D E R

This Contempt Petition is filed alleging willful disobedience of the order passed by this Court in WP.No.23367 of 2018  dated 02.09.2022.

  1. The respondent herein earlier filed the above Writ Petition seeking for issuance of a direction to the first respondent therein to conduct Balalayam in Sri Punnaivananathar Sannidhi with immediate effect and make necessary arrangements for consecration of a new peacock idol which represents Parvathi Devi, with a flower in its beak, as per Agama Shastra. This Court, by an order, dated 02.09.2022 disposed of the said Writ Petition on the following lines:

“6. The petitioner and applicants in the impleadment applications would not involve themselves to make a comment in reference to each other after preparing a video or going on social media, which may affect their image in the society. It would be in reference to this case and even otherwise. Both the parties shall conduct themselves.”

  1. It is the submission of the learned counsel for the petitioner that though this Court by an order dated 02.09.2022 directed both the parties not to make any allegation against each other affecting their image in public, the respondent has made a few abhorrent tweets against the petitioner.
  2. When the petition came up for hearing on 12.10.2022, this Court made an observation that prima facie the respondent has tweeted some messages quite contrary to the direction of this Court. Since the counter affidavit is not convincing to accept the apology, the respondent was

directed to file a better affidavit.

  1. Today, the respondent appeared before this Court as

party-in-person and filed a better affidavit, dated 18.10.2022 tendering an unconditional apology and also given an undertaking to delete the tweets on

02.09.2022 on his twitter handle @OurTemples.

  1. Recording the undertaking given by the respondent and also accepting the unconditional apology, this contempt petition is closed.
