The unsuccessful Candidates filed about 54 writ petitions challenging the TNPSC section List and also sought for publication of written examination marks of all the candidates .

By an common order dated 5.8.2021, Learned single judge directed Publication of marks of all candidates who have undertaken written exams conducted by TNPSC for post of “MV Grade II ” even before viva voce was completed .

Challenging the order of Learned Single Judge, batch of Writ Appeals were filed by TNPSC. The matter was heard by first bench comprising of Hon’ble Chief Justice and Hon’ble Justice Bharatha Chakravarthy on 18.3.2022.
Mr P. Wilson Senior Advocate appearing for Mr Karthikrajan TNPSC counsel submitted that when the vivia voce has not been completed and selection process is in the midway, the direction to disclose the written examination marks would tilt fair interview and affect the recruitment process . He also submitted that the said order is against the full bench decision of the Madras High court as well the order of Supreme Court.
Mrs Nalini Chidambaram Senior Advocate , appearing for unsuccessful candidates submitted that the learned judge has relied upon judgement of Supreme Court and has come to a conclusion that in public interest the marks can be disclosed.

Refusing to concur with submissions of Unsuccessful candidates, the Hon’ble Chief Justice bench distinguished the said order of Supreme Court that it is on the issue relating to disclosing of information under RTI Act and doesn’t apply to the facts of the case .
However Concurring with the submissions of Mr P. Wilson that there could be no direction to publish the written marks even before the oral interview is over, the Chief Justice bench relying upon full bench and Supreme Court, set aside the order of Learned Single judge directing to publish the written exam marks of MV Grade II posts and requested to proceed with hearing of batch of Writ Petitions pending before learned single judge
Thereupon all the Respondent counsels agreed to cooperative for a final hearing of Writ Petition before learned Single judge.
Recording the same the Hon’ble Chief Justice Bench requested the Learned single judge order to hear all the matters on 31.3.2022.
Interestingly the 2018 notification issued for recruitment of 113 posts for MV Grade II posts is yet to be completed and is entangled in legal proceedings and is still pending in HC
