Though directions were issued by this Court on 08.09.2023, to
conduct an enquiry, identify the illegalities, irregularities and corrupt activities in allotment of free Government house sites, the Authorities have not initiated swift action.

  1. The District Collector, Kallakurichi submitted a
    comprehensive report on 11.02.2024 stating that 90 Government house sites were allotted illegally to ineligible persons. The Report was communicated to the Directorate of Vigilance and Anti Corruption.
  2. The learned Additional Public Prosecutor, appearing on
    behalf of the second respondent, would submit that the Report was received by the Vigilance and Anti Corruption Department on 13.05.2024 and actions are initiated to commence the investigation by following the procedures.
  3. When prima facie case has been made out for prosecuting
    the persons for corrupt activities and illegal allotment of Governments free house sites, the Authorities are expected to investigate the matter without causing any undue delay. The long delay would frustrate the proceedings, since some of the officials may retired from service or left the services. In such matters relating to corrupt activities are to be taken immediately by conducting investigation and by following the procedures. The Authorities cannot wait for the orders of the Court in such matters. It is the duty cast upon them to initiate action.
  4. The parties, who possess information about the corrupt
    activities and illegalities, are at liberty to submit their statements, documents etc., before the Deputy Superintendent of Police, Vigilance and Anti Corruption concerned.
  5. Therefore, the respondents are directed to proceed with the
    action immediately in coordination with the District Administration and with other connected Departments and prosecute the offenders in the manner known to law. The Action Taken Report is directed to be submitted before this Court on 20.09.2024.
