He argued that the Judicial Officer had violated Section 389(3) of Cr.P.C by refusing to receive the petition to suspend the sentence though the conviction was only for 3 years. The Bench accepted the argument and has asked for the report of the Magistrate along with the case records. The CCTV footage of the court has also been directed to be preserved.
