Actress Jayapradha case was listed before the Hon’ble Dr. Justice G. Jayachandran today. Abdul Hameed, Senior Counsel appeared on behalf of Actress and Former Member of Parliament, Mrs.Jayapradha and argued that contribution amount claimed by ESI was paid even before the order of conviction was passed by the Learned Magistrate . However without taking into account of the same, conviction order was passed and also directed to pay the contribution amount within two months. Challenging the said order of conviction, appeal was filed along with the petition to suspend the sentence on the ground that on account of hospitalisation she could not be present, when judgement was passed and so could not inform the court of the mitigating circumstance. However the Hon’ble PJ court though had admitted the Appeal , had dismissed the petition filed for suspension of sentence. Aggrieved by the same, petition under 482 was filed seeking to set aside the order of dismissal of suspension of sentence. The counsel appearing for ESIC Mr.Kowshik had filed typed set of papers claiming a sum of Rs.37,00,000/- from Mrs. Jayapradha towards interest on the contribution amount. The learned senior counsel for Mrs Jayapradha had submitted interest is being claimed for the periods, for which neither demand was made nor order under section 45 A of ESI was was passed. Further the interest is being claimed for periods for which no prosecution is launched. However during the course of hearing, heeding to the suggestion of the Hon’ble court, Mrs. Jayapradha had undertaken to deposit a sum of Rs.20,00,000/- within a reasonable time. Upon consideration, the Hon’ble judge was pleased to reserve the case for orders.
