⁃ Before Your Lordship could begin , I am appearing for the officers my lord and I want to place certain facts , the officers cannot be stigmatised without being heard
⁃ I have seen that memo filed by the SPP.
⁃ NAVJ says Both judgements are formatted same , AG replied maybe there are some copy pasting
⁃ There are Supreme Court judgements on discharge and the methodology right from P. Sirajuddin till the latest 2023
⁃ My concern is only with regards that officers shouldn’t be stigmatised
⁃ Lordship is aware that Enhancement notice and suo moto will normally go before a different judge than the judge who has issued notice , I could have waited and made the same submission before the judge but I want to make these submissions before you because you will appreciate our stand and defer
⁃ NAVJ says I’m issuing notice , you might argue it thereafter
[8/24, 06:57] sekarreporter1: அப்போது அரசு தலைமை வழக்கறிஞர் ஆர்.சண்முகசுந்தரம் ஆஜராகி, அமைச்சர்களுக்கு எதிரான சொத்து குவி்ப்பு வழக்குகளின் விசாரணை நடைமுறையில் எந்த தவறும் இல்லை. இந்த வழக்குகளில் லஞ்ச ஒழிப்புத்துறையின் விளக்கங்களை கேட்காமல் உத்தரவு பிறப்பித்தால் அது அந்த அதிகாரிகளை களங்கப்படுத்தியதாகி விடும். உச்ச நீதிமன்ற உத்தரவுகளைப் பின்பற்றியே இந்த உத்தரவுகளை கீழமை நீதிமன்றம் பிறப்பித்துள்ளது. கீழமை நீதிமன்ற தீர்ப்புகளை எதிர்த்து தாமாக முன்வந்து எடுக்கப்படும் இதுபோன்ற வழக்குகள் தவறான முன்னுதாரணமாகி விடும். பொதுவாக இதுபோல தாமாக முன்வந்து எடுக்கப்படும் வழக்குகள் வேறு நீதிபதிகளின் முன்பாகவே விசாரணைக்கு பட்டியலிடப்படும், என்றார்.
