Ref:    My letter dated 15.10.2022

 

 

  1. Vide my letter dated 15.10.2022, I had apprised your good self about the rampant injustice done to the MRC candidates belonging to OBC in the counselling process while filling up the All-India Quota UG and PG medical/dental seats for the academic year 2021. I had highlighted that the correct counselling procedure for MRC students was not followed due to which their seats has been illegally appropriated from the quota meant for OBC students as a result of which a meagre 6 reserved seats were allotted to OBC students which resulted in a loss of 2163 OBC seats. Furthermore, I had requested your good self to kindly direct the Director General of Health Services to provide the mandated benefit of reservation of 27% to the students of the OBC community from the Academic Year 2022 onwards in All India Quota Medical seats for both UG and PG levels for medical and dental seats and implement the correct counselling procedure with respect to the Meritorious Reservation Category students.

 

  1. I was hopeful that my letter dated 15.10.2022 would have at least evoked some consideration of the issue from your end. However, I am deeply saddened to note that as per the representation sent by MEDICOS PARENTS ASSOCIATION, ANDHRA PRADESH to me dated 27.10.2022, for the Academic Year 2022 as well, the correct counselling procedure is again not being followed. As per the Round 1 of the NEET UG 2022 counselling results, only 49 seats have been allotted to OBC students. As per this representation received by me, in the first counselling, 2445 seats out of 8916 seats contributed by States to All India Quota are reserved for OBC students. These seats have to be allotted only after the completion of allotment of General Seats(open competition)to OBC candidates. But even this year about 2396 seats meant for OBC students have been illegally misappropriated and the seats allotted to MRC candidates in open competition have been counted against the OBC quota. This is not only a blatant discrimination, but also a major illegality. It is shocking that through counselling, OBC students are constantly being denied of their constitutionally mandated reservations.

 

  1. After a long struggle, from the completion of report by the Mandal Commission in 1980 to the judgement passed by the Hon’ble Supreme Court in Neil Aurelio Nunes vs. Union of India (2022) 4 SCC 1, the OBC’s are yet to attain an equitable opportunity to study in higher educational institutions.

 

  1. Such non-compliance with the correct counselling procedure in allotment of seats to MRC candidates intentionally by the MCC and DGHS is not only a flagrant violation of the judgements passed by the Hon’ble Supreme Court but also reveals deliberate institutional discrimination by the Director General of Health Services which is illegal and is an act of atrocity committed against students belonging to Other Backward classes which has to be viewed very seriously. These actions are nothing but misappropriation of OBC seats & breach of trust and I demand accountability and departmental action personally against the erring officials.

 

  1. Every year, a substantial number of seats are being snatched away meant for OBC students due to such institutional discrimination and illegal counselling procedure adopted by DGHS. However, this year all is not lost, for NEET UG, as only the first round has been completed with the second round yet to start from November onwards. Hence, it is an appropriate time for your good self to intervene and to look into the matter and issue necessary directions to the Director General of Health Services to rectify the Round 1 of the NEET UG 2022 counselling results and strictly implement the correct counselling procedure for the remaining counselling rounds.

 

  1. Therefore, I seek your kind attention to this most pressing issue and request you to do the needful to ensure the strict implementation of the correct counselling procedure as laid down by Hon’ble Supreme Court with respect to Meritorious Reservation Category candidates by allotting seats from open category in various judgments and further provide the mandated benefit of reservation of 27% to the students of the OBC community in the Academic Year 2022-2023 in All India Quota Medical seats and ensure that the entire seats are allotted to the OBC students and are fully utilized.

 

  1. I also request your good self to kindly constitute an enquiry committee against MCC and DGHS officials at the Ministerial level to enquire into this huge systemic illegalities of deliberate misappropriation of seats meant for the Other Backward Classes by adopting illegal counselling procedure for MRC Students and to initiate necessary departmental action against erring officials besides set right the injustice done to the Other Backward class students by redoing the entire counselling procedure and ensure that such violations are not repeated in the future.
