[8/26, 07:17] Durai Arun: Kanal Kannan Bail Petition is Dismissed by the Hon’ble Principal Sessions Court Chennai.

We are appeared on behalf of the Defacto Complainant, Mr.Kumaran District Secretary of Thanthi Periyar Dravidar Kazhagam, Chennai and vehemently objected for granting bail to the accused Kanal Kannan.
Further , we put forth and set forth our arguments as follows;
The accused has no fear on the law enforcing agency and keep on delivered various hatred speeches against his political opponents is gross violation, intentionally he created violence through his speech and the accused should have dealt with an iron hand. the accused remains undeterred and, in the event, if the accused is granted bail, who is already, has no fear on the legal action , who delivered a worst ever comment against the Thanthai Periyar, Musalman, Christrians and Oppressed People will continue his acts of derogating his opponents.

Learned Senior Advocate R.C.Paulkanagaraj wants to describe the cruel act of the accused as mere speech. But its not a mere speech ,it is a hatred speech in the language of the Supreme court, it’s targetting unrest among the people of Tamil nadu, it is targeted speech against Periyar and his ideology. He wanted to create violence in the name of religion and worship.he has not mere speaking for applause ,appreciation for somebody, he wants the human bloodshed on the street of peaceful Tamil Nadu in the name of religion. Hence the Hon’ble court would not allow such kind of hatred speech. Learned senior appeared for the accused has argued that 41 Crpc is not complied with, therefore he entitled for Bail. Its not a matrimonial dispute, property dispute, if he didn’t arrested , surely the law and order problem would happened, hatred speech leads to genocide, it’s a grave in nature , not simple in nature.

Moreover the hatred speech is the reason for all the genocide, over the past 75 years hate speech has been a precursor to atrocity, crimes , Genocide from Bosnia to Cambodia to Srilanka.

The accused deliberately delivered a speech that the day of the statue of the Periyar who said there is no God, in front of the temple in Srirangam is demolished, will be the day of Hindu uprising.
While he delivered the above said speech there was a power cut, after the power has come , he delivered the very same speech, therefore it can’t be said the he suddenly delivered a speech.
He and his association targeting unrest among the entire Tamil Nadu ,thereby there are planning to rule over Tamil Nadu. Periyar had been continuously and consecutively fought for the temple entry right of the people who were denied to enter into the temple.

From the very beginning he fought for equality of the Majority people of other Backwards and Scheduled Castes were denied to study , walk on the roads , enter into the temple, he questioned those things, they were denied all those rights in the name of caste , in the name of religion, finally the reson assigned by them as the rights were denied in the name of religion, hence he questioned the God that how can a god failed to treat its people equally. Therefore he said that there is no God.

He can not be merely labelled as the propagandist for atheism. His views on caste oppression, social equality, women liberation surpasses the teaching of many contemporary leaders of India.
Therefore the speech of the accused is not attack on the statue of Periyar , it is an attack on the statue of empowerment , development of Backward class ,Most Backward class and Scheduled Castes, Tribes. If the Bail is granted to him, it would send out a wrong message to the society that would give signals to deliver a very same speech.

Hence the Hon’ble Principal Sessions Court dismissed the bail plea of the accused Kanal Kannan.
