Pursuant to the submission of learned Advocate-General, the Tamil Nadu Pollution Control Board is added as a party to the present proceedings

. Further, the Ministry of Environment and Forests is also

added as a respondent to the present proceedings.

  1. Learned Amicus, previously appointed in the matter, should indicate the particulars of the added respondents through an officer of

this court, so that appropriate notices may therefor be issued.

  1. A summary of the key issues involved has been filed dated November 12, 2021 by Dr.V.Suresh, Amicus Curiae. According to some of the tables forming a part of the summary, raw sand, garnet,

ilmenite, rutile, zircon, sillimanite, leucoxene had been extracted in large quantities by the mining operators and a substantial part thereof in a clandestine or unlawful manner, without reporting the same. Though some of the appearing mining operators object to the report, it appears that the activity had gone unnoticed over a long period of time

and may not have received adequate attention of the State

government.

  1. Learned Advocate-General seeks time to deal with the report on the summary as filed by Dr.Suresh. Mr.Srinath Sridevan appearing

for VV Minerals also seeks leave to object to the report.

  1. Any individual mining operator seeking to take exception to the report should file its individual counter-affidavit within a week from date. The State will deal with the report, along with the counteraffidavits filed by the individual mining operators, by way of a status report to be filed within three weeks from date. The State will indicate, in particular, the extent of vigilance now exercised in the three southernmost coastal districts, where, according to Dr.Suresh, such illegal mining operations continued unabated till the end of 2016. The Pollution Control Board may also file an independent report if it has

taken any action in respect of such perceived illegal mining.

List the matter on 03.12.2021.
