Sankaran and Some Writ Petitions were Represented by Advocate Mrs. Selvi George and Some Writ Petitions were Represented by Advocate Mr. E. Martin Jayakumar, the Government filled the counter and contested the case. After hearing his Lordship was pleased to allowed the Writ Petitions by setting aside the G.O.Ms.No. 247 & 248 and consequently direct the Government to continue the selection process for 1146 posts from which it was stopped pursuant to G.O.Ms.No.56 dated 21.03.2020.

The petitioners are Guest Lecturers who are having NET, SET P.hd., having prescribed qualification as per the UGC Norms. They were selected through proper selection from the year 2000 working in various govt arts science colleges in the state of Tamilnadu. They have originally paid honorium 50 per hour and gross salary 2400 per month subsequently this was revised and their salary was Rs.15000 per month as per G.O.Ms.No.247 Higher Education (F2) Department dated 08.11.2022. the petitioners through their association namely Tamilnadu Government Colleges Guest Lecturer Welfare Association Rep by its Secretary Mr. Arunagiri, submitted several representations for the post of Assistant Professor. The petitioners have been continuously working without any break. For some individual Government passed individual order for regularization regularizing the service during 1996. However since no orders of regularization was passed for Guest Lecturer working for more than 15 years based on the representation govt issued
G.O.Ms.No.56 Higher Education (F2) Department dated 21.03.2020 in which the govt decided to regularize the services of the Guest Lecturer by appointing them as Assistant Professor. by prescribing a minimum 5 years of service as Guest Lecturer as an essential qualification. And prescribing the cutoff date as
13.09.2019 those were working on the date servicing as on 13.09.2019. As per this it is directed the selection of Guest Lecturer to be regularizes shall be restricted to 1146 Guest Lecturer for the year 2017-18 2018-19 shall be earmarked in two faces. As per the Government Order the selection is directed to be conducted among the Guest Lecturer for assessing the eligibility of the candidates by scrutinizing the application, and certificate verification by the committee and through interview. Petitioners were issued with call letter for Certificate Verification during Feb 2021 and their certificate were duly verified by the committee and they were waiting for regularization order. Writ Petitions were filed before the Madurai High Court as per proceeding dated 12.02.2021 where in Certificate Verification called for. In which they have submitted that the TRB invited application for the Direct Recruitment for 2331 posts for the year 2018-19. This Writ Petition were dismissed by the Madurai High Court holding that 1146 vacancies as stated in G.O.Ms.No.56 Higher Education (F2) Department dated 21.03.2020 are exclusive from the 2331 vacancies for which notification issued for the direct recruitment. Now the Government issued the
G.O.Ms.No.246 dated 08.11.2022 G.O.Ms.No. 246 dated 08.11.2022 introducing a competitive written examination and interview procedure for direct recruitment to fill up the post of Assistant Professor in Collegiate Education by dispensing with the existing method of awarding of weightage marks. The Government also issued G.O.Ms.No.247 dated 08.11.2022 by which it is directed that the Guest Lecturer are allowed to participate in the written competitive examination as a onetime measure in supersession of G.O.Ms.No.56 dated 21.03.2020 by stating that the Guest Lecturers shall be awarded weightage of two marks for each academic year on teaching experience, subject to maximum of 15 marks for the years of service rendered in Government Colleges as onetime measure. These two G.O. was challenged by Association and individual Guest
