SITTING ARRANGEMENT – PARTIAL MODIFICATIONS 

 

The following partial modifications are made in the Sitting Arrangement in the Principal Seat at Madras with effect from 19.01.2023. 

Principal Seat at Madras  

  1. Hon’ble First Division Bench consisting of the Hon’ble Acting Chief Justice and Hon’ble Mr.Justice D.Bharatha Chakravarthy will take up Writ Petitions – Public Interest

Litigations (PILs); Writ Petitions or PILs challenging the vires of the Act, Rules or Regulations (except Writ Petitions and PIL relating to GST Act, Rules or Regulations including those cases challenging the vires of the GST Act, Rules or Regulations); Writ Petitions relating to Encroachments – from the year 2021; Writ Petitions/Writ Appeals filed by or against the High Court; Writ Petitions relating to Elections or against Election Commission (including those cases filed before the Madurai Bench) except cases invoking the provisions of Criminal Procedure Code and other Criminal Laws; Writ Appeals against final orders which are not specifically assigned to any other Division Bench (other than Tax matters) – from the year 2021; Writ Appeals against Interlocutory/Interim Orders passed by Single Bench (other than Tax Matters) – from the year 2021; SARFAESI, IBC and other Bank related cases in connection with SARFAESI – from the year 2021; All Commercial Appellate Division Appeals arising from Commercial Division of High Court to be heard by Division Bench (including matters involving more than Rs.500 cr.); Commercial Appellate Division Appeals from Commercial Courts to be heard by Division Bench; Cases relating to National Company Law Tribunal.

 

 

  1. Hon’ble Division Bench consisting of the Hon’ble Mr.Justice S.Vaidyanathan and Hon’ble Mr.Justice J.Sathya Narayana Prasad will take up Writ Appeals relating to Labour against Final Orders passed by Single Bench; Special Tribunal Appeals; First Appeals and Second Appeals to be heard by Division Bench – from the year 2017.

IIA. When Division Bench is not sitting Hon’ble Mr.Justice S.Vaidyanathan will take up Old Writ Petitions relating to Service from the provisional list.

IIB. When Division Bench is not sitting Hon’ble Mr.Justice J.Sathya Narayana Prasad will take up Old Civil Miscellaneous Appeals from the provisional list.

  • Hon’ble Division Bench consisting of the Hon’ble Mr.Justice R.Mahadevan and Hon’ble Mr.Justice Mohammed Shaffiq will take up Tax Cases arising from Direct Tax Laws (like Income Tax Act, Wealth Tax Act); Tax cases arising from

Indirect Tax Laws (including Customs, Central Excise, GST, Sales Tax etc.); Writ Petitions and PIL relating to GST Act, Rules or Regulations including those cases challenging the vires of the GST Act, Rules or Regulations; All other Appellate Side

Cases to be heard by Division Bench which are not specifically assigned to any other

Division Bench – from the year 2020; Original Side Appeals – from the year 2018; Writ Petitions and Writ Appeals relating to Judicial Service and service of court-employees including High Court employees; Writ Appeals relating to Service against Final Orders passed by Single Bench – from the year 2021; Writ Petitions relating to Encroachments – up to the year 2020; SARFAESI, IBC and other Bank related cases in connection with SARFAESI – up to the year 2020.  

 

IIIA. When Division Bench is not sitting Hon’ble Mr.Justice R.Mahadevan will take up Old Writ Petitions relating to Service from the provisional list.

IIIB. When Division Bench is not sitting Hon’ble Mr.Justice Mohammed Shaffiq will take up Old Writ Petitions relating to Service from the provisional list.

  1. Hon’ble Division Bench consisting of the Hon’ble Mr.Justice M.Sundar and

Hon’ble Mr.Justice M.Nirmal Kumar will take up Habeas Corpus Petitions; All Criminal Appeals and other Criminal Cases to be heard by Division Bench (including crime against women and children); Criminal Contempt and Appeals relating to orders in Contempt Proceedings; All Division Bench matters, including Criminal Appeals and Writ Petitions, relating to criminal cases involving the sitting or former M.Ps and M.L.As (including those cases filed before the Madurai Bench).

IVA. When Division Bench is not sitting Hon’ble Mr.Justice M.Sundar will take up Old Writ Petitions relating to Service from the provisional list.

IVB. When Division Bench is not sitting Hon’ble Mr.Justice M.Nirmal Kumar will take up Old Criminal Appeals from the provisional list.

  1. Hon’ble Mr.Justice Abdul Quddhose will take up Writ Petitions relating to Tax matters (including Income Tax, Sales Tax, Motor Vehicles Tax), Customs and Central Excise, Prohibition and State Excise; Writ Petitions relating to Co-operative Societies.
  2. Hon’ble Mr.Justice N.Anand Venkatesh will take up Writ Petitions relating to

Labour and Service – from the year 2020.  

 

  • Hon’ble Ms.Justice R.N.Manjula will take up Criminal Original Petitions (under Sections 407 and 482 Cr.P.C.), Writ Petitions (Cr.P.C.) – from the year 2019 to 2021; Criminal

Appeals (including appeals relating to crime against women and children) and Criminal Revisions – up to the year 2019.

  1. The urgent matters pertaining to the Division Bench presided over by the Hon’ble Acting Chief Justice be placed before the Division Bench presided over by Hon’ble Mr.Justice S.Vaidyanathan.
  2. The urgent matters pertaining to the Division Bench presided over by Hon’ble Mr.Justice S.Vaidyanathan be placed before the Division Bench presided over by Hon’ble Mr.Justice R.Mahadevan and Vice Versa.
  3. The urgent matters pertaining to the Division Bench presided over by Hon’ble Ms.Justice V.M.Velumani be placed before the Division Bench presided over by Hon’ble Mr.Justice S.S.Sundar and Vice Versa.
  4. The urgent matters pertaining to the Division Bench presided over by Hon’ble Mr.Justice R.Subramanian be placed before the Division Bench presided over by Hon’ble Mr.Justice M.Sundar and Vice Versa.
  5. The urgent matters pertaining to the Court presided over by Hon’ble Mr.Justice Abdul Quddhose be placed before the Court presided over by Hon’ble Mr.Justice N.Anand Venkatesh and Vice Versa.
  6. The urgent matters pertaining to the Court presided over by Hon’ble Mr.Justice V.Sivagnanam be placed before the Court presided over by Hon’ble Ms.Justice R.N.Manjula.
