This Review Application has been filed to review the order dated 28.04.2023 made in O.S.A.No.17 of 2022.
2. When the matter is taken up for hearing, Mr.M.R.Jothimanian, learned counsel appearing for Administrator General and Official Trustee of Tamil Nadu, sought time to file a report.
3. Heard Mr.R.Srinivas, Senior Counsel for Mr.S.Sai Shankar, learned counsel for the Review Applicant, Mr.G.Murugendran, learned counsel for R4 & R5, Mr.A.K.Athiban Vijay, learned counsel for R1 and Mr.C.Sathish, learned Government Advocate for R2.
4. Learned counsel appearing for the respective parties have submitted that pursuant to the order (under review) of this Court, a general paper publication had already been effected.
5. On a perusal of the pleadings and upon hearing the submissions of the counsel, it appears that they want a change of Administrator and to appoint a new one in the place of Justice S.Jagadeesan, a Retired Judge of this Court. When this Court suggested names of three Retired Judges of this Court, namely, Justice N.Kirubakaran, Justice V.Bharathidasan and Justice V.Parthiban, they have chosen the name of Justice V.Parthiban for the purpose of appointment as Administrator of the Trust.
6. In view of the above, Justice V.Parthiban, a Retired Judge of this Court is appointed as Administrator of the Trust, who shall take over the charge from the present Administrator for smooth conduct of election, dayto-day affairs of the Trust, etc. The remuneration so fixed for the present Administrator shall be paid to the newly appointed Administrator. If need be, it is open to the Administrator to take the assistance of two Advocates, viz., Mr.Sharath Chandran (Mobile No.98844-45442) and Mr.K.Madhu
(Mobile No.94893-48262) & Police.
7. List this matter on 02.01.2024 for filing report by the AG&OT. It is made clear that except the change of Administrator, the rest of the order dated 28.04.2023 shall remain unaltered.
