*PEARLS OF WISDOM (LATEST JUDGEMENT)* The *Hon’ble Justice R.N. Manjula* was pleased to allow C.R.P. (PD) No. 1824 of 2022 and thereby directed the husband of the Petitioner to leave the matrimonial home where the Petitioner and the children live within a period of two weeks failing which he shall be removed with the help of police protection and held as follows:-

*PEARLS OF WISDOM (LATEST JUDGEMENT)*

The *Hon’ble Justice R.N. Manjula* was pleased to allow C.R.P. (PD) No. 1824 of 2022 and thereby directed the husband of the Petitioner to leave the matrimonial home where the Petitioner and the children live within a period of two weeks failing which he shall be removed with the help of police protection and held as follows:-

1) If one party unfurls unruly and aggressive attitude and in such an unreasonably adverse situation, the Petitioner (wife) and her children can not be compelled to live under constant fear and insecurity.

2) If the removal of the husband from the home alone is the only way to ensure domestic peace, the Courts need to pass such orders irrespective of the fact that whether the Respondent (husband) has or has not another accommodation of his own, by relying on the decision of the Hon’ble Supreme Court in the case of _Samin Vidya Sagar Bhardwaj vs. Nandita Samin Shardwaj, reported in (2017) 14 SCC 583._

3) The order of protection given by the Learned Trial Judge should be workable and practical one. Allowing the Respondent to be as the same home, but directing him that he should not disturb the other inmates of the home is something impractical. A relief for a person who fears about an impending atom bomb, would be just to remove the bomb from his/her vicinity.
