PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, to direct the second respondent to transfer the Patta in the name of the petitioner’s name in respect of the property situated at Survey No.28/1A and 28/1B at Velliyur Village of an extent of 0.53 cents with Bore well and electricity service connection.

O R D E R
This Writ Petition is filed for issuance of mandamus simplicitor to direct the second respondent/The Tahsildhar to transfer the Patta in the name of the petitioner’s name in respect of the property situated at Survey
No.28/1A and 28/1B at Velliyur Village, of an extent of 0.53 cents with Borewell and Electricity Service Connection.
2. When the matter came up for hearing on 08.11.2023, the learned Additional Government Pleader reported before this Court that he took notice on behalf of the respondents and sought adjournment for filing counter. Therefore, Registry was directed to list the matter on 28.11.2023, directing the respondents to file counter on or before 27.11.2023.
3. Today, when the matter was taken up for hearing, counter affidavit has not been filed by the respondents.
4. Since the writ petition is filed only for issuance of a simple writ of mandamus to consider the online application for transfer the Patta in the name of the petitioner, it would suffice to direct the respondents to issue notice to the petitioner and also to the adjacent land owners of the four boundaries of the subject matter property, and if any other interested parties / rival claimants and after giving notice to all of them, the enquiry be conducted in the manner known to law and orders be passed in accordance with the law.
5. The said exercise shall be completed within a period of two months from the date of receipt of a copy of this order.
6. With the above directions, the Writ Petition is disposed of. No costs.
7. Since this Court has already given a direction and passed an order with regard to the applications/petitions/appeals/revisions and etc., filed before the appropriate authorities, to dispose of the cases as such, within the stipulated time, as per the order dated 09.06.2023 in a batch of writ petitions in W.P. No.262 of 2018, passed by the learned Judge of this Court, in D.Tulasi Vs. The District Revenue Officer, Dharmapuri and etc., and as per a Circular No.R1/2005632 /2022 dated 17.07.2023 issued by the Commissioner of Land Administration, but, the Revenue
Authorities are not following the directions issued in the said Judgment of this Court or the Circular issued by the Commissioner of Land Administration.

It is the duty of the Government officials to comply with the directions of this Court and the Circular of the Commissioner of Land Administration, in which, the time has been fixed to dispose of the application/petition/revision/appeals and etc., whereas, in this case, it is seen that the petitioner has made representation before the first and second respondents on 03.05.2023 itself. But, so far the petitioner has not recieved any notice, and the first respondent has not taken any steps to consider the representation of the petitioner. This lethargic attitude of the Revenue Officials is highly condemnable.
9. Therefore, the Chief Secretary, Chief Secretary’s Office, Government of Tamil Nadu, Secretariat, Chennai-600 009 is directed to take departmental action against the respondents 1 & 2 herein, within a period of two months from today and file a report before this Court.
10. Registry is directed to list the matter under the caption “for reporting compliance” for submitting the action taken report filed by the Chief Secretary, on 30.01.2024.
