*M. Venkatesan Vs. The District Registrar (Administration) & Anr.*
W.P. No. 33186 of 2022

*HON’BLE MR. JUSTICE R.SURESH KUMAR* disposed of the Writ Petition in the matter relating to *“Registration – Civil Court Decree – Circular to be issued”*, set-aside the impugned order and further observed and held as follows:

i) The issue raised in the Writ petition is whether limitation shall not stand in the way for registering the Civil Court Decree, which has already been settled by this Court in W.P.(MD) No. 13896 of 2019 and W.P. No. 4591 of 2020, that limitation shall not stand.

ii) Despite repeated orders of the Hon’ble High Court, Sub-Registrars are refusing to register Civil Court Decree and Judgement citing limitation. This Court issues the following directions:

a. That the Sub-Registrar shall register the Civil Court Decree and Judgement presented without insisting any limitation.

b. That the Registration fee shall only be calculated based on the value of the suit filed and not based upon the value of the property.

c. That the Inspector General of Registration shall issue necessary circular to all Registrars to strictly follow the judgement of this Court in W.P.(MD) No. 13896 of 2019 and W.P. No. 4591 of 2020 etc.

d. That despite the circular being issued by the Inspector General of Registration, if it is violated by any of the registering authority, that would be viewed seriously and action would be initiated under Section 68 of the Registration Act, 1908.
