The petitioner seeks direction against the respondents to fill up the post of Registrar and Controller of Examination for which advertisement No.PU/RC/2020/37 dated 08.09.2020 was issued by the 1st respondent.

  1. The Pondicherry University is without a regular Vice
    Chancellor and Registrar. After the filing of the writ petition, Controller of Examination has been appointed.
  2. It is submitted that on 10.01.2022, notification was issued, inviting applications for the post of Registrar. On 17.08.2023, candidates were shortlisted. It is submitted that at present, there is incharge Vice Chancellor. As such, the first respondent University is awaiting approval from the Ministry of Education.
  3. It appears that Selection Committee will have to be freshly constituted.
  4. The Selection Committee consists of
    (1) Vice-Chancellor to be Chairperson of the Selection
    Committee
    (2) An Academician who is the nominee of the Visitor
    (3) Three experts in the concerned subject/field out of the list recommended by the Vice-Chancellor and approved by the Executive Council
    (4) Dean of the Faculty
    (5) Head/Chairperson of the Department
  5. One of the contentions is that regular Vice-Chancellor is not in office and in-charge Vice-Chancellor is functioning. The regular ViceChancellor has already demitted office in October 2023. The full fledged Registrar to the first respondent University is not appointed since the year 2014 barring a brief period.
  6. The position today is the University does not have a regular Vice-Chancellor nor a regular Registrar. Certainly, a sorry state of affairs.
  7. The University Grants Commission has also communicated the first respondent University that the approval of University Grants Commission is not required to fill the post of Registrar.
  8. The in-charge Vice-Chancellor shall proceed ahead for filling the post of Registrar as contemplated under the statute. The publication was already given inviting applications for the post of Registrar. The same has also been received. On 17.08.2023, the candidates are also shortlisted. The process is underway. There is no necessity to stall the said process only because the regular ViceChancellor demitted the office. In case the Selection Committee is not constituted, the same shall be constituted immediately as provided under the statute. The in-charge Vice Chancellor shall do the needful.
  9. Before the next date, the steps undertaken hereafter shall be placed on record by the first respondent.
  10. Place the matter on 10.04.2024.
