Pursuant to the directions issued by this Court, the
Devasthanam, Superintendent of Police and Inspector of Police have filed their reports before this Court.

  1. The contempt petitioner alleges that still there are three
    encroachments in the nature of shops in the Girivala Pathai, which are yet to be removed. Therefore, the revenue officials have not complied with the earlier directions issued by this Court.
  2. Learned Special Government Pleader, on instructions from
    Mr.T.Kaliappan, Revenue Inspector, Palani Town, who is present before this
    Court today, submits that on 06.03.2024, notice have been issued to those

    encroachers directing them to vacate the premises on or before 14.03.2024, failing which necessary action will taken for removal of encroachments.
  3. In this regard, the Revenue Department shall file a report
    before this Court on the next hearing date.
  4. Learned counsel appearing for Devasthanam made a request
    that there is a municipality land in T.S.No.12 and if the said land is given to the Devasthanam either on lease or assignment, the Devasthanam will utilize the said land for parking of vehicles of the devotees, pilgrims and the general public in order to avoid vehicular congest.
  5. In this regard, learned Standing Counsel appearing for Palani Municipality has no objection and he submits that if the Devasthanam makes any such proposal to the Municipality, the same will be placed before the Council Meeting and the said request will be considered positively as per the rules in force.

  6. The Joint Commissioner / Executive Officer, in paragraph No.4
    of his report, dated 12.03.2024, seeks a direction to the Police Department to deploy sufficient police force in the places earmarked in the said report, in three shifts round the clock for effective implementation of the orders passed by this Court and to prevent the public or the vendors from parking their two wheelers wantonly to create disturbance to the devotees.
  7. Learned Additional Public Prosecutor, on instructions, submits
    that the Devasthanam shall also make necessary arrangements for
    deployment of their own security personnel along with the police personnel in the places earmarked in the report. He further submits that in addition to the police personnel deployed by the Deputy Superintendent of Police, as per the request made by the Inspector of Police, 82 police personnel in three shifts are required, which includes the deployment of additional police personnel in the spot.

  8. In this regard, the Superintendent of Police is directed to take
    note of the above request of the Devashanam and provide necessary police personnel as required by the Devasthanam in its report dated 12.03.2024 and as per the report of the Inspector of Police, Palani Town Police Station, dated 10.03.2024, to ensure free flow of traffic and no untoward incident or law and order problem is taken place, without any further delay. It is made clear that this arrangement is only for a time being and till the further orders are passed by this Court in this regard.
  9. Needless to state that the Devasthanam shall make necessary
    facilities / arrangements to the police personnel during their duty time.
  10. To be noted, it is the responsibility of the Police Department, Municipality and Revenue Department to regulate the traffic congestion, including parking of vehicles of the devotees during the festival seasons.
  11. Learned Additional Public Prosecutor submits that since there
    is no post of Assistant Superintendent of Police in Dindigul District, the

    Deputy Superintendent of Police, Palani, will take the responsibility of monitoring of all the works carried out by the Police Department and regulate the traffic pursuant to the earlier directions issued by this Court.
  12. Learned counsel for the Devasthanam, on instructions,
    submits that pursuant to the directions issued by this Court earlier, the Panchamirtham Stalls in the Girivala Pathai have been removed and the said places will be utilized for providing Reverse Osmosis water to the devotees.
    This submission of the Devasthanam is recorded.
  13. The Joint Commissioner / Executive Officer, in Paragraph No.
    11 of his report dated 12.03.2024, seeks a direction to the Water Resources Department to remove the residential encroachments in the northern edge of Vaiyapuri Canal in the southern Girivala Pathai.
  14. In this regard, the Water Resources Department, Palani, shall
    take necessary arrangements for removal of those encroachments and file a report before this Court on the next hearing date. It is needless to state that during the course of removal of those encroachments, if any request is made

    by the encroachers for providing alternative accommodation, the same will be considered by the Water Resources Department.
  15. With regard to the grievance of private shop owners, learned Additional Advocate General, on instructions, submits that the Revenue Divisional Officer has forwarded his report to the Monitoring Committee.
  16. The Monitoring Committee shall take note of the report
    forwarded by the Revenue Divisional Officer and file a report before this Court on the next hearing date.
  17. To be noted, during festival seasons, the Devasthanam, Municipality and the Police Department shall take all necessary arrangements for parking of vehicles of the devotees or pilgrims enabling them to reach the Girivala Pathai without any difficulty.
  18. On 08.03.2024, when the matter came up for hearing, learned
    Additional Advocate General, based on the report submitted by the Revenue Divisional Officer, dated 07.03.2024, submitted that except 120

    encroachments in Survey Nos.864/1 to 864/8, all other encroachments in the Girivala Pathai have been removed and for the said 120 encroachers, notices have been served directing them to vacate the premises on or before 13.03.2024, failing which necessary action will be taken for removal of encroachments.
  19. In this regard, the Revenue Department shall file a report
    before this Court on the next hearing date.
  20. The Joint Commissioner / Executive Officer, in his report
    dated 12.03.2024, seeks a direction to the Palani Municipal Administration and Police Department for placing barricades to prevent vehicle movements in Sannathi Street and Ayyam Pulli Street for the effective implementation of the orders of this Court.
  21. In this regard, necessary assistance shall be rendered by the Municipality as well as the Police Department and a report shall be filed before this Court on the next hearing date.

  22. Post the matter on 19.03.2024 at 02.15 p.m., for filing further
    reports by the Monitoring Committee and Revenue Department as directed above.
