The Supreme Court approved the DMK government’s off-shore Pen Memorial project in memory of its patriarch and former chief minister M Karunanidhi, dismissing Writ Petition under Article 32 challenging the decision. The bench comprising of Justice SK Kaul and Justice Sudhanshu Dhulia, concurred with the submissions of Senior Advocate P Wilson, and refused to entertain the plea moved by Nallathami representing fishermen and Impleading applicant Jayakumar, former fisheries Minister (AIADMK) and dismissed it as devoid of merits while granting the leave to approach any other authority.

The petitioner wanted to restrain construction of Pen Memorial under the guise of environmental concerns and fisherman livelihood .
Opposing the plea, Senior Advocate P. Wilson argued that the petition was devoid of any merits and that coastal regulation clearance had been obtained for the memorial. He submitted that there is no harm either to fisherman or to the olive turtles . He submitted that the PIL is a shadow fighting initiated at the instigation of AIADMK. The Impleadment Application filed by Former Minister of Fisheries D. Jayakumar belonging to AIADMK proved the same . The AIADMK when they were in power in 2018 refused to grant 6 feet of burial ground to Dr. Kalaignar and now they’re behind constructing of pen memorial and the writ petition is politically motivated petition and there is no public interest in it.
