Today, the Writ Petitions for issuance of quo warranto against Hon’ble Ministers Thiru Udhayanidhi Stalin and Thiru P.K. Sekar Babu and Hon’ble MP Thiru A. Raja filed by office bearers of Hindu Munani came up for hearing before the Hon’ble Mrs. Justice Anita Sumanth of the Madras High Court.
The petitioners argued that for the alleged speech of Hon’ble Ministers about Sanatana Dharma, a writ of quo warranto must be issued.
Mr P.Wilson , Sr. Advocate appearing for Mr Udayanidhi Stalin contended that the writ petition is misconceived and not maintainable. The prayer for quo warranto is maintainable only writ petitioner proves that there is violation with regard to appointment to the public office or any disqualification under the constitution or laws. In this case no such disqualification is attracted. Holding a political view point cannot be a disqualification he argued. He further submitted a few judgements to say that such writ petitions are not maintainable.
After hearing both sides, the Hon’ble Court has posted the case for arguments on maintainability and production of alleged speech on 11/10/23 .
