JUSTICE V. PARTHIBAN W.P.No.8284 of 2020In the conspectus of the above discussion and narrative, this Court has no hesitation in allowing the Writ Petition. The impugned order of the fourth respondent in Na.ka.No.A3/02600/2020 dated 09.04.2020 is hereby set aside and the respondents are directed to consider the claim of the petitioner for his appointment to the post of Grade-II Police Constable, Jail Warder and Fireman in the appropriate post as per his rank and eligibility without reference to the involvement of the petitioner in the criminal case as indicated in the impugned proceedings, if he is otherwise fit in all other respects. The authorities are directed to pass appropriate orders in compliance with the above direction within a period of eight weeks from the date of receipt of a copy of this order.

[7/10, 15:19] sekarreporter1: The Writ Petition filed by one KK Ramesh Advocate before Supreme Court challenging construction of Pen Memorial for late kalaignar came up for hearing before the bench comprising of Hon’bleChief Justice of India and Hon’ble Mr Justice PS Narasimha The bench after hearing arguments Jaya Sukin for petitioner and of P. Wilson senior advocate appearing for Tamilandu Government dismissed the writ petition as devoid of merits. The writ petitioner in his petition wanted the court to restrain construction in all coastal states especially pen memorial due to raising sea level and in his grounds of writ petition sought to exhume the mortal remains of Anna, MGR , Jayalalithaa and Kalaignar laid to rest at Marina and wanted to be shifted to other places and to restrain the TN Government using of Marina for future burials. The Hon’ble CJI bench declined to entertain the writ petitions and dismissed the same.
