The matter mentioned pertains to the illegal encroachment of public property doing charity works in seerkazhi and in connection to the same a subsequent attack on the lawyer. Learned Senior Counsel Mr.S.Prabakaran vehmently brought into the notice of the Hon’ble court that when the illegal sale and encroachment of town property was questioned by the said Balasubramanium after collecting the RTI reports, the said Balasubramanium was brutally attacked by goondas and henchmen and further his office was also ransacked by those members who have illegally attacked the lawyer. In this regard when a complaint was lodged by the Balasubramanium the concerned police authorities took a counter complaint from the alleged illegal encroacher and registered FIRs against both the parties. Learned Senior Counsel Mr.S.Prabakaran contended that inspite of suffering injuries still admitted in hospital and the complaint being given by the said Balasubramanium the state police authorities have registered FIR after getting the counter complaint from the illegal encroacher which is erroneous and illegal and is done with malafide inetntion. It was further argued by the learned senior counsel that the State Grievance redressal committee is not in operation inspite of slew of directions given by this Hon’ble Court.
The Hon’ble Acting Chief Justice questioned about the remedy and learned Senior Counsel requested the intervention of the Hon’ble Court and further submitted that when the lawyers are unrully the Bar Council takes action and when they suffer it is the duty of the Bar Council to safegaurd the interest of the lawyers and in this regard learned Senior Counsel sought intervention of the Hon’ble Court.The Hon’ble Judges observed orally that they will look into these matters and that they will find out the suitable remedy. Further Learned Senior Counsel and K.Balu learned counsel requested the Hon’ble Court to revive the State Redressal committee for which the Hon’ble court observed that they will do the needful.
