Sekar Babu and Hon’ble MP A. Raja, the Hon’ble Mrs. Justice Anita Sumanth reserved the matter for orders after hearing the arguments in reply of Mr. P. Wilson Sr. Advocate for Mr. Udhayanidhi Stalin, Mr. R. Viduthalai Sr. Adv. for Mr. A. Raja and Mr. N. Jyoti Sr. Adv. for Mr. P.K. Sekar Babu. The Hon’ble Court has granted one week‘s time for filing written submissions. In reply to the submissions of Mr. G. Rajagopalan who argued that the DMK leaders are speaking against Hindus, Mr. Wilson said that the majority of the State and even the majority of the DMK’s cadres are Hindus and that it is the Hindus who have elected the DMK. He further retorted that those who cannot beat NOTA need not claim to be representatives of Hindus. He further pointed out such submissions reveal that this writ petition is a political battle and appealed to the Court to not allow the Court to be used for political and ideological battles.

In reply to the submissions of Mr. G. He further submitted that prescribing the disqualifications for MPs and MLAs is the sole prerogative of the Parliament under Article 191 (e) and that the Courts should respect the separation of powers. He argued that only when there is any vacuum in the constitution, the court can intervene but not when the Parliament has already prescribed certain disqualifications. He appealed that the Court should not transgress into the exclusive domain of the Legislature and prescribe any additional disqualification as suggested by Petitioners. He submitted that the entire writ petition is frivolous and abuse of process and is liable to be dismissed with exemplary costs.

After hearing all arguments, the Hon’ble Court has reserved the matter for orders and has permitted the parties to file their written submissions within a week.
