Various State transport corporations filed writ petitions challenging the collection of toll free rules 2008 which is applicable to 6 lane widening. According the rule 2008 the toll owners shall collect 75% of total fixed toll till completion of 6 lane widening completed. Till completion of such projects no annual revision (increase toll yearly) can be implemented.

And as per Rules 2008, the toll owners violated all these rules and forced the state transport to pay full toll to each trip with anual revision of toll.
Further we challengeed that the agreement entered NHAI and toll owners and notification of widening from 4 lane to 6 lane by NHAI are mandated to get approval from Both Houses.

This has not been approved by Parliament, hence the toll owners cannot collect toll free since their agreements are not enforceable.

Further Govt Buses are non commercial vehicles since RTC Act 1950 of Union act, the state was obligated to form transport corporations to give better connectivity of rulral and needy people as service.

So transport corporation buses shall be collected regular toll free under commercial vehicles.
For non commercial vehicles the toll free comes about 500 RS per annum during 2011.
